1. PRIVACY STATEMENT

Introduction
The purpose of this document is to set out the privacy entitlements of Data Subjects, as defined in the General Data Protection Regulation (GDPR), of living persons. Privacy can only apply to information that is not already in the public domain, and GDPR only applies to such personal data.
The General Data Protection Regulation (GDPR) is a European Union Regulation that sets out the data entitlements of data subjects and the obligations of those who process the personal data of data subjects. GDPR seeks to protect and enhance the rights of data subjects. These rights cover the safeguarding of personal data, protection against the unlawful processing of personal data, and the unrestricted movement of personal data within the EU.
Personal Data
KATAKEY Consulting collects data from you and uses that data to place you in employment with third parties, which involves making telephone contact with you, emailing you with positions that may be of interest to you, and sharing your data with potential employers. Our company, in its capacity as your agent, operates as a Data Controller in respect of the personal data you supply to us. We share your data with third-party clients in order to advance your prospects of obtaining your desired position, and we require our clients to handle your data in a manner consistent with GDPR through the agreements described in the Disclosure section below.
We collect personal data about you from your CV, application forms and questionnaires you may be asked to complete; we also gather personal data from records of our correspondence, phone calls, and emails.
Data Subjects
This company has different categories of data subjects:

Data subjects who are general candidates looking for temporary or permanent work.

Data subjects who are engaged in a contract of employment by our company are to be placed in temporary assignments in our client companies.

Data subjects who are our own internal employees carrying out the work of the recruitment agency.

Data subjects who are the contacts within our client companies and supplier/service provider organisations.
There are different categories of data required between the different data subject categories, and only the information necessary to conduct the contractual relationship and perform the contract unique to each data subject, will be collected.
The legal basis for processing any personal data
This company relies upon the following legal bases for data collection:
Contract: Information is required in order to perform the contract of employment agent on behalf of you, the candidate, to potential employers. The basis of data gathering in that instance is contractual requirements. This will include identification information such as but not limited to name, address, date of birth, information regarding education/qualifications, and reference checks. We share your CV and contact details with prospective employers whom we have matched to your skills and competencies, so they can reach you directly to progress your application.
Legitimate Interest: Information is processed in the legitimate interests of the business of the employment agency, and where so processed it will be in accordance with and subject to your data subject rights and entitlements. Our legitimate interest is that we require suitable candidates to supply to clients, and clients with whom to place candidates, in order to carry out the recruitment service. In balancing the data subject protection rights against the legitimate interest of our company, we have considered:

The frequency of notifications to you, in order to ensure that no nuisance is caused to you;

The security and integrity of the data you have provided;

Your rights and entitlements to stop the processing of your data with ease, and to this end we have created an easy path through which you can exercise your data subject rights via the contact details supplied in this notice.
We will promote our services via a number of methods, including direct marketing, on the basis of this legitimate interest, using the contact details of data subjects who have a connection with this company — either by applying to a job ad through a third party, by being a registered candidate in our talent database, contacts within our client and prospective client companies (B2B basis processing), or social media connections. At all times we will make it easy for the data subject to exercise their data subject rights via an email to KPoberezhets@katakeyconsulting.com.
Consent: Where we process any special category data (such as health information you volunteer, for example to discuss a reasonable accommodation), we rely on your explicit consent for that specific processing. You can withdraw this consent at any time by emailing KPoberezhets@katakeyconsulting.com, without affecting the lawfulness of processing carried out before withdrawal.
Automated decision-making: We do not make decisions about your candidacy or suitability for a role using solely automated means, including profiling. All recruitment decisions involve human review.
Disclosure
It is necessary as part of our contractual requirements to share your data with our clients — e.g. prospective employers — and contract partners, in order to advance your prospect of securing the position you want. We have in place Data Sharing Agreements (in the form of actual agreements or additional clauses within the terms and conditions of engagement between the agency and its clients) or Data Processing Agreements with all such employer/clients, requiring them to process your data in a manner consistent with this Privacy Notice and GDPR. Where data is transferred to another party, we ensure appropriate technical and organisational safeguards are used to protect your personal data.
We do not broker or pass on information gained from your engagement with the agency for purposes unrelated to recruitment. However, we may disclose your personal information to meet legal obligations, regulations, or valid governmental requests. The agency may also enforce its Terms and Conditions, including investigating potential violations of its Terms and Conditions, to detect, prevent or mitigate fraud or security or technical issues, or to protect against imminent harm to the rights, property or safety of our company, its clients, and/or the wider community.
Data Breach Notification
If we become aware of a security incident that has led to accidental or unlawful destruction, loss, alteration, or unauthorised disclosure of or access to your personal data, we will investigate without undue delay, take steps to contain and address the impact, and notify you where the breach is likely to result in a risk to your rights and freedoms. Where required by law, we will also notify the Data Protection Commission.
Retention Policy
We process personal data for the duration of any contract or engagement, and continue to store only the data needed afterwards to meet legal obligations or legitimate business needs, as set out below:

Pre-recruitment / candidate registration — to register a candidate's interest and match them to roles. Retained up to 6 months from last contact.

Recruitment and selection — to assess candidate suitability for a specific role (CV, application materials). Retained up to 6 months from the closing of that search, unless the candidate opts in to remain on file for future roles.

Career consulting engagement — to deliver and follow up on paid consulting sessions. Retained up to 6 months from last contact.

References — to verify candidate suitability at a client's request. Deleted once the associated recruitment process closes, unless needed for a dispute.

Employer/client contact details — to manage the recruiting relationship with client companies. Retained for the duration of the relationship, plus up to 12 months after the last engagement.

Payment and invoicing records — legal obligation under Irish tax law. Retained 6 years plus the current year.
You may opt out of being retained beyond an active process at any time by emailing KPoberezhets@katakeyconsulting.com.
After the applicable period, any personal data no longer needed is deleted.
Your rights as a Data Subject
For the entirety of the time that we have your data, you have the following rights:

Right of access — you have the right to request a copy of the information we hold about you.

Right of rectification — you have the right to correct data we hold about you that is inaccurate or incomplete.

Right to be forgotten — in certain circumstances you can ask for the data we hold about you to be erased, and we will comply with this request in accordance with our own obligations to keep records for statutory purposes.

Right to restriction of processing — where certain conditions apply, you have the right to restrict the processing.

Right of portability — you have the right to have the data we hold about you transferred to another organisation.

Right to object — you have the right to object to certain types of processing, such as direct marketing.

Right to object to automated processing, including profiling — you have the right not to be subject to the legal effects of automated processing or profiling.
These rights may on occasion need to be modified or curtailed by statutory or competing obligations — for example, if we have been your employer, we can only delete your data after the statutory record-retention period has expired. Where we must refuse or place conditions on a request, we will explain why, and you have the right to challenge that legally.
At any time, following a request from you, we can confirm what information we hold about you, as well as how and why it is being processed, including: the identity and contact details of the data controller; the purpose and legal basis for processing; the categories of data collected; who it's disclosed to; how long it's stored; your rights to correct, erase, restrict or object; your right to withdraw consent; how to lodge a complaint with the supervisory authority; and, where relevant, the source of the data if not collected directly from you.
Verifying your identity for access requests
We will accept the following forms of ID when personal data is requested: a copy of your national ID card, driving licence, passport, or birth certificate, plus a supporting document such as a utility bill no older than three months. A minimum of one piece of photographic ID and one supporting document is required. If we are not satisfied with the quality of the ID provided, further information may be requested before data is released.

3. TERMS & CONDITIONS
About these terms
These terms govern your use of katakeyconsulting.com and any paid career consulting services purchased through the site (Career Clarity Session, Career Accelerator, Career Partnership). By using the site or booking a service, you agree to these terms.
Our services
KATAKEY Consulting provides:

Recruitment services to employers (no direct charge to candidates).

Paid career consulting services to individuals, delivered online, as described on the relevant service page at the time of booking.
Bookings and payment

Services are booked via our online booking page. Prices are shown in EUR at the time of booking.

Payment is required in full at the time of booking, via our payment provider.

For single-session bookings (Career Clarity Session): if you cancel at least 48 hours before your scheduled session, you will receive a full refund. If you cancel with less than 48 hours' notice, or do not attend (a "no-show"), no refund will be issued.

For multi-session packages (Career Accelerator, Career Partnership): the package is valid for 1 month from the date of your first session, and all included sessions must be scheduled and completed within that period. If you miss a scheduled session within the package without at least 48 hours' notice, that individual session is forfeited and will not be refunded or rescheduled — the rest of the package remains valid for its remaining sessions within the 1-month period.
No guarantee of employment outcome
Career consulting services provide guidance, feedback, and strategic advice. KATAKEY Consulting does not guarantee any specific employment outcome, interview, or job offer as a result of these services.
For employers using our recruitment services
Separate commercial terms may apply to recruitment engagements with employer clients and will be agreed directly at the time of engagement.
Intellectual property
All content on this site (text, graphics, resources such as CV templates or salary guides) is owned by KATAKEY Consulting or its licensors and may not be reproduced without permission, except for personal, non-commercial use.
Limitation of liability
To the extent permitted by law, KATAKEY Consulting is not liable for any indirect or consequential loss arising from use of this website or its services.
Governing law
These terms are governed by the laws of Ireland, and any disputes will be subject to the exclusive jurisdiction of the Irish courts.
